Terms of service

1. Agreement:

- My Dutch Lessons will do its utmost to realize the agreed training objectives;

- My Dutch Lessons will guarantee absolute confidentiality regarding all confidential information that is provided by your organization and

employees;

- My Dutch Lessons will ensure that the agreed services will be performed in such a manner that the interests of the client and his employees are

central;

- My Dutch Lessons will do its utmost to ensure that the agreed training dates are adhered to, except for unforeseen circumstances and in cases

when, for example, a replacement for the trainer is required due to illness. If My Dutch Lessons is unexpectedly obliged to postpone or cancel a

 training session, then the contact person and course participants will be notified;

- The price stated in the quote is leading to any rates published on our website.

2. Payment

- Payment should be effected 14 days after the invoice date, and before the start of the training program;

- If the complete amount for the program has not been paid on the first day of the program, My Dutch Lessons is not obliged to provide the

 agreed training program.

- If a client/course member has failed to pay as agreed and subsequently neglects to pay on time the invoice and the interest which is due, then My Dutch Lessons has the right to claim the extrajudicial collection of the outstanding debt and the ensuing costs are to be paid by the

negligent client/course participant. In addition to interest, the collection fees will also be charged to the client/course participant.

3. Rules for cancellation and change for courses

Two course sessions can be rearranged free of charge by the student, provided that the change is communicated in writing to My Dutch Lessons (e-mail or WhatsApp) at least twenty-four hours (one day) before the start of the session concerned. The course session is then scheduled for another time. In the event of rearrangement/cancellation within twenty-four (one day) and in the event that the maximum number of rearrangements/cancellations is exceeded, the cancelled course day(s) will not be replaced. For group courses, this rule applies to the entire group and not the individual students within the group.

A course must be completed within a year after commencement. My Dutch Lessons reserves the right to terminate the course after this period has elapsed.

The rules and provisions in the present article only apply if the cancellation is reported in writing by the client/student at least twenty-four (one day) in advance to the course administration and if scheduling of the new date takes place by the client/student in consultation with the course administration.

Should the client or student wish to postpone the course after confirmation of the course, the agreed course fees remain payable. If the notification of the postponement is received by My Dutch Lessons by e-mail no later than ten working days before the first day of the course and the course is taken within six months, there will be no associated extra charges. If these conditions are not fulfilled, My Dutch Lessons reserves the right to charge extra administration costs.

If a student/client cancels the course between 30 and 15 days prior to the start of a course (regardless of the reason), 50% of the course fee is due. If the cancellation takes place within 15 days prior to the start of the course, 100% of the course fee is due.

In the event of cancellation by My Dutch Lessons, course fees that have already been paid relating to course sessions not yet taken will be refunded.

Rules for cancellation and change for intensive courses

If a course is cancelled by the student or the client, regardless of the reason, within a period between 10 and 6 working days before the start of the agreed date of the course, 50% of the course fee is due. If a course is cancelled after this period or if the student does not turn up, then 100% of the course fee is due.

If, between 10 and 6 working days before the start of the course, a student or client requests postponement of the course and My Dutch Lessons agrees with the postponement, then the course fee is increased by 25%. If a course is postponed within 5 working days before commencement, then the course fee is increased by 50%. In the event of an inability to attend during the course, the missed hours are lost.

Once courses have been postponed, they cannot be postponed or cancelled again.

Cancellations and postponements may only be requested in writing and must be received by My Dutch Lessons before the above-mentioned periods.

4. Disputes

Disputes shall as far as possible be resolved between the client and My Dutch Lessons. Should a difference of opinion nevertheless remain, this agreement shall be governed by Dutch law. The court in Utrecht has jurisdiction over disputes arising from or in connection with this agreement.

5. Authorship and ownership

My Dutch Lessons reserves all rights for the course material provided. Without prior permission, nothing from said material or publication(s) may be reproduced, stored in a database, or published using print, photocopy, or other media. It is not permitted to provide the course material to third parties.

6. Privacy statement

My Dutch Lessons is careful in the handling of information provided by its (potential) clients. Personal details are carefully handled and protected. My Dutch Lessons complies in all cases with the Dutch Personal Data Protection Act (Wet Bescherming Persoonsgegevens).

7. Recording and handling data

My Dutch Lessons records the data of (potential) clients to inform them of its products and services and thereby enable a good and reliable performance of its training and development programs. 8. Liability

If My Dutch Lessons is liable, only damage which is directly caused by My Dutch Lessons through negligence will be considered for compensation. Consequential damages (including damages related to business or income) are therefore excluded.

9. Applicable law

All agreements with My Dutch Lessons are concluded under Dutch law.
